Obama DOJ Found Evidence of Ilhan Omar’s Suspected ‘Sham Marriage’

The Trump administration has exposed how federal investigators under former President Barack Obama’s administration uncovered evidence suggesting that Rep. Ilhan Omar (D-MN) may have entered into a fraudulent marriage with a man suspected of being her brother. The findings raise fresh questions about allegations that have followed the Minnesota Democrat throughout her political career.
The FBI and Department of Homeland Security reportedly examined Omar’s 2009 marriage to Ahmed Nur Said Elmi, a British citizen, during the summer of 2016. According to The New York Times, six current and former federal officials familiar with the investigation said agents discovered evidence suggesting the two individuals were siblings. However, prosecutors ultimately declined to pursue criminal charges because they believed the suspected offense had fallen outside the applicable five-year statute of limitations.
The revelation represents a significant development because Omar has repeatedly characterized the accusations as a politically motivated conspiracy theory. Although investigators reportedly identified information supporting suspicions about the marriage, the precise evidence remains publicly undisclosed. No court has determined that Elmi is Omar’s brother, and the congresswoman has consistently denied any wrongdoing.
According to the Times, the original investigation involved an FBI agent experienced in public corruption and civil rights matters, along with two agents from Homeland Security Investigations, a division of Immigration and Customs Enforcement. The agents examined allegations that the marriage had been arranged to obtain immigration benefits for Elmi.
Two former officials also reportedly disclosed that Elmi received a provisional two-year green card through his marriage to Omar. When he subsequently sought permanent residency, immigration authorities requested additional documentation establishing that the relationship was legitimate.
Rather than submitting the requested documentation, Elmi reportedly departed the United States and abandoned his application for permanent residency. The circumstances became another point of interest for investigators examining whether the marriage had been genuine.
The allegations originally surfaced publicly in 2016, when Omar was campaigning for a seat in Minnesota’s state legislature. She had recently defeated a longtime Democratic incumbent when questions about her marriage history began circulating through Somali community discussions and conservative media outlets.

At the time, Omar strongly rejected the accusations. In a statement reported by the Associated Press, she declared, “Insinuations that Ahmed Nur Said Elmi is my brother are absurd and offensive.”
Her campaign received additional support from an August 22, 2016, letter written by Andrew Luger, the Obama-appointed U.S. attorney for Minnesota. Luger stated, “My office is not investigating, nor have we requested an investigation into Ms. Omar.”
Omar’s supporters subsequently pointed to that letter as evidence that the accusations lacked credibility. However, Luger recently clarified to The New York Times that his statement “was never meant to say anything about the substance of the claims.”
Luger explained that his correspondence addressed a specific media report suggesting his office had requested an immigration investigation. He acknowledged that federal agents could have been independently examining the allegations without his knowledge.
The newly disclosed information also complicates earlier assertions that federal authorities had definitively disproven the accusations. Investigators reportedly identified suspicious circumstances but lacked the prosecutorial authority and investigative resources necessary to fully pursue the matter.
Omar’s relationship history has attracted scrutiny for years. She entered a religious marriage with Ahmed Hirsi before legally marrying Elmi in 2009. After separating from Elmi in 2011, she resumed her relationship with Hirsi and eventually obtained a legal divorce from Elmi in December 2017.
The renewed attention comes as President Donald Trump’s Justice Department conducts a separate investigation into Omar’s immigration and citizenship history. Federal agents searched her Washington, D.C., residence on October 12 and seized electronic devices and other materials as part of their inquiry.
Investigators are also reportedly examining questions involving Omar’s personal identification records, including discrepancies concerning her reported birth year and information submitted during her family’s immigration process. Whether any inaccuracies were intentional or legally significant remains undetermined.
Omar has condemned the current investigation as an attempt “to target political enemies and weaponize federal law enforcement.” Former President Obama has similarly criticized the Trump administration, arguing that the government should not pursue individuals because of their political views.
Federal prosecutors have not announced criminal charges against Omar in connection with the current investigation. The Justice Department has also sought to keep portions of the search warrant documentation sealed while investigators continue reviewing the evidence.
The latest disclosures nevertheless establish that questions surrounding Omar’s former marriage received federal investigative attention during the Obama administration, years before the current inquiry. Whether the renewed investigation will produce additional evidence or criminal proceedings remains uncertain, leaving the controversy unresolved as Omar approaches the November 3 midterm elections.
