DOJ Sues School District Over Gender Plans Parents Never Saw

The Justice Department sued Unified School District No. 500 — Kansas City, Kansas, Public Schools — on Monday, alleging the district helps students socially transition at school while hiding the process from parents.

Federal lawyers say the district’s internal transgender guidelines violate the Family Educational Rights and Privacy Act and the Protection of Pupil Rights Amendment.

The guidelines let a transgender or “gender non-conforming” student request a planning meeting. Topics can include a preferred name, pronouns, gender designation, school records, restrooms, locker rooms, sports, field trips, and staff training.

Students may also ask that parents be left out. Administrators and the district attorney then weigh age, grade, welfare, and other factors.

If they approve, staff can write a “Gender Plan,” file it internally, and skip sending a copy home. An implementation meeting follows with employees. Parents are not required to attend.

“A record concealed from a parent, created in meetings the parent was deliberately excluded from and retained in administrative files without parental awareness, is de facto inaccessible,” the complaint says.

The government also says parents get no real chance to challenge, correct, or delete what is in the plan, and that students may face sensitive discussions or evaluations without prior written parental consent.

Versions of the guidelines have been in use since at least 2017. The current version dates to 2024 and, according to the filing, never received a formal vote from the elected school board.

The Education Department opened an investigation in August 2025. By July 2026 it found reason to believe the district was not substantially complying with federal privacy law and sent the case to Justice.

The district denies a blanket ban on parental access. General Counsel Gregory Goheen wrote in August that USD 500 “does not, nor has it ever, prohibited parental access to student records based on a student identifying as transgender.” Officials asked Washington to name specific violations.

The administration wants a judge to declare the guidelines unlawful, block them, require parental consent before certain evaluations, and guarantee parents a chance to review and challenge the records. The case is in the District of Kansas. It is the Trump DOJ’s first lawsuit aimed squarely at a district policy for assisting transgender students without guaranteed parental involvement.
