Spotsylvania County Commonwealth’s Attorney Ryan Mehaffey, a Marine veteran, announced he will not enforce Virginia’s newly signed assault weapons ban, calling it unconstitutional.
The law, signed last week by Democratic Gov. Abigail Spanberger, bans the future sale and manufacture of many semiautomatic rifles, pistols, shotguns, and magazines holding more than 15 rounds. It takes effect in July.
Mehaffey sent a letter to the county sheriff stating the ban violates the Second Amendment and Virginia’s historical tradition of citizens arming themselves for community defense.
He argues modern infantry weapons like the M4 carbine with 30-round magazines are protected.
Smyth County Commonwealth’s Attorney Phillip Blevins has also refused to enforce the law on constitutional grounds.
The ban faces multiple lawsuits from gun-rights organizations including the NRA.
Spanberger’s office called the measure a “critical step” for public safety.
