Federal Judge: Ban on Guns in U.S. Post Office Facilities Is Unconstitutional

U.S. District Judge Kathryn Kimball Mizelle ruled that the prohibition against firearms in U.S. Post Office facilities violates the Constitution, following a case involving a postal worker, Emmanuel Ayala, who was charged with illegal possession of a firearm in a federal facility.

Ayala argued that the historical record does not support a law banning firearms in post offices, and Mizelle agreed, dismissing the charge and stating that it violates Ayala’s Second Amendment right to bear arms.

The ruling is based on the requirement, set forth by the Supreme Court’s Bruen decision, for gun controls to demonstrate historical precedent in U.S. history. (Trending: Bombshell UFO Footage Released To The Public)

Ayala said the prohibition is “unconstitutional as applied to him because the historical record does not support a law banning firearms in post offices.”

Judge Mizelle wrote that the United States’ position was “that the Second Amendment allows it to punish the bearing of arms inside any government building.”

Mizelle rejected the government’s claim that classification as a “sensitive place,” allows the government to “ban the carrying of firearms while not violating an individual’s Second Amendment rights and is consistent with the Nation’s historical tradition of firearm regulation.”

“[Bruen] requires the United States to present historical support for § 930(a)’s application to Ayala, which it fails to do. Post offices have existed since the founding, as have threats to the safety of postal workers and the public entering those locations,” wrote Mizelle.

“Yet the historical record yields no ‘distinctly similar historical regulation addressing’ those safety problems by regulating firearms in post offices….Bruen deems this absence strong evidence of the statute’s unconstitutionality,” explained the judge.

Mizelle ruled, “I dismiss the § 930(a) charge because it violates Ayala’s Second Amendment right to bear arms.”
