Famed Harvard Law Prof: Jack Smith Could be Indicted for Fraud

Special Counsel Jack Smith’s vendetta to take down former President Donald Trump could backfire, according to Harvard Law School professor emeritus Alan Dershowitz. Smith recently indicted Trump on four criminal charges related to his alleged involvement in the events of January 6, 2021.

Dershowitz noted how Smith omitted a key portion of then-President Donald Trump’s speech in Washington, D.C. on January 6th. At Trump’s “Stop the Steal” rally, Smith emphasized how Trump told supporters to “fight like hell,” but failed to mention Trump ordered everyone to “peacefully and patriotically make your voices heard.”

According to Smith’s own definitions and standards in the indictment, Dershowitz says he could be charged with fraud for still charging Trump and omitting his orders to be peaceful.

“Under the indictment itself, Jack Smith could be himself indicted,” Dershowitz said bluntly. “He told a direct lie in this indictment. He purported to describe the speech that President Trump made on January 6th.”

“And he left out the key words, when President Trump said, ‘I want you to demonstrate peacefully and patriotically. You know, a lie by omission, under the law, can be as serious as a lie by commission,” he added. (Trending: Disney Just Pulled A Bud Light…)

It’s no surprise that Smith is willing to commit alleged fraud to attack Trump. Critics say the move is politically motivated and election interference as Trump is the 2024 Republican Party frontrunner.

Trump was also indicted on 37 charges related to the alleged mishandling of classified documents. Biden allegedly told U.S. Attorney General Merrick Garland to investigate Trump and Merrick proceeded by appointing Smith in November 2022 to the case.

If Trump wins the 2024 presidential election, he has vowed to fire Special Counsel Jack Smith who is leading the investigation into Trump’s alleged improper retention of classified records.

A Trump campaign spokesperson said, “This is nothing more than a continued desperate and flailing attempt by the Biden Crime Family and their Department of Justice to harass President Trump and those around him.”

“Deranged Jack Smith knows that they have no case and is casting about for any way to salvage their illegal witch hunt and to get someone other than Donald Trump to run against Crooked Joe Biden,” the spokesperson added.
