Jack Smith Urges Appeals Court To Reject Trump’s Immunity Defense

Special counsel Jack Smith urged the federal appeals court to reject Donald Trump’s attempt to dismiss the 2020 election case, arguing that Trump’s claims of presidential immunity threaten the democratic and constitutional foundation of the Republic.

Trump’s legal team asserted that the indictment is unlawful and unconstitutional, citing double jeopardy violations.

The trial is scheduled to start on March 4, 2024, but the debate over presidential immunity may impact the schedule.

Smith wrote that Trump “threatens the democratic and constitutional foundation of our Republic.”

Smith’s team requested a quick ruling from the appeals court to set the stage for any further challenges.
